[1] One of its key requirements is supply chain security. [2]

This text is not a law lecture. It shows what the supply chain is in practice, where an IT professional working at a client fits into it, and what to expect.

In short: 5 things to remember

Companies covered by the Act (the Act calls them essential and important entities) must ensure the security of ICT (Information and Communication Technology) products, services, and processes supplied from outside. [3] A consultant with access to their systems is part of that chain.

Responsibility for this lies with the client’s management, and from April 2028, financial penalties may be imposed for failures. [4, 5]

Requirements reach the consultant mainly through the client’s contract and procedures, not directly from the Act.

An exception worth noting: for some roles, the client must ask for information from the National Criminal Register (KRK). Keep this in mind if you need to join a project quickly. It is worth getting such a certificate in advance (you can apply online – the answer takes a few days – or get it immediately at a court that handles such applications. And note – you do not have to go to the court competent for your place of residence. In particular, you do not have to go to the court in Katowice; the queues for KRK certificates there are already too long. I recommend the courts in Sosnowiec or Gliwice :)) [6]

The client has 24 hours for the first report of a significant incident. Elements that are hard to check and prove, such as “vulnerability” or “quality”, have been added to the technical assessment. How do you check and document them? Perhaps that is a topic for another article, “How to live with imprecise requirements”.

The Directive also encourages putting security requirements directly into contracts with suppliers. Atende informed its clients about the data concerning them and extended two-factor authentication to all VPN accounts. [13]

In January 2025, EuroCert, a trust service provider (including qualified signatures and seals) for many public institutions, fell victim to a ransomware attack. The Government Plenipotentiary for Cybersecurity advised the company’s contractors to, among other things, block remote access and IT infrastructure links with EuroCert, change credentials for related accounts, and implement two-factor authentication. [13] Both cases show the same thing: an incident at a supplier quickly becomes its clients’ problem. When a supplier has an incident, the client first cuts off its access – and then asks what safeguards it had.

Three project scenarios

The scenarios are illustrative and do not describe specific clients.

A. It is the client’s management that is responsible for cybersecurity, even when it entrusts certain tasks to someone else. The financial penalties provided for in the Act can only be imposed 2 years after it entered into force, i.e., from April 2028. The external consultant is not the addressee of this liability. However, if they “contribute” to an incident, the situation is quite different, and we enter the territory of contractual liability.

The absence of liability under the Act does not mean that nothing changes for the consultant.

The changes are mainly contractual and organizational:

Longer onboarding. The client must ensure personnel security and training [14] – hence, additional statements and training before access is granted.

Criminal record information – for some roles. If the consultant is to help build the client’s security system or handle incidents, before starting work, they present information from the National Criminal Register confirming no conviction for offenses against the protection of information.

Strict access management. An account still active after the project ends is a risk an auditor will spot first.

Fast escalation. It is worth having the reporting deadline and path written into the contract.

For the legal department to check: can the IT supplier itself be covered by the Act?

The sectors covered by the Act also include managed service providers (whether a company is actually covered depends on, among other things, its size), i.e., companies that install, maintain, or administer the client’s systems – on-site or remotely. [16] A company supplying consultants who administer clients’ systems should assess whether part of its business falls within this definition. If so, the obligations may apply to it directly, not only through contracts with clients.

Clients in the banking sector

For banks and financial market infrastructure, the EU sector-specific act is the DORA Regulation, and the Polish Act excludes most of the ISMS and incident reporting requirements for them. However, the rules on management responsibility, training, and criminal record information still apply to them. [17] For the consultant, the effect is similar: questions about vetting, access, and incidents will be asked anyway.

Cheat sheet: the client’s question – where does it come from?

The client asks…

What lies behind it

Who exactly on your team has access?

Access control and asset management [14]

How do you vet consultants?

Personnel security; for some roles, criminal record information [14, 6]

Has the consultant completed training?

The obligation to train personnel [14]

How quickly will you notify us of an incident?

24 h/72 h reporting deadlines [7]

Do you use subcontractors?

Assessment of supplier quality and security [12]

Quick test: Is your team ready for NIS2?

Do you know what the consultant vetting and onboarding process looks like in your area?

Can you say in one sentence what you do when you notice something worrying in the client’s system (who, how quickly, through which channel)?

Do you know when access is revoked after a project ends or a role changes?

Does the standard contract include clauses on incidents, team changes, and audit rights, or do you add them every time?

Is there one person or team responsible for answering clients’ security questionnaires?

Do you know whether your role at the client may require criminal record information?

            <picture>

        </picture>

Cybersecurity

We protect your data and IT environment with modern solutions and services – audits, penetration testing, continuous monitoring and incident response.

        Cybersecurity offering

Summary

For a client covered by the new rules, it makes no difference whether its environment is accessed by an external system or an external person.
